ADHESION TERM

1 - THROUGH THE DEFINITIONS:
1.1 – The following definitions are relevant:
I – USER: Person who acquires and uses Rio de Janeiro Pass
II – CITYWAYPASS: is the juridical person of private right regularly subscribed at the CNPJ/MF under the number 11.585.464/0001-23 which the social reason is Citywaypass Intermediação de Negócios Ltda. with headquarter in the city of Santana de Parnaíba, State of São Paulo, at Rua Texas, 69, Conjunto 05, Jardim Rancho Alegre, CEP: 06515-200, being responsible for the issue and the administration of Rio de Janeiro Pass card.
III - THE ACCREDITED PERSON WHO OFFERS THE SERVICE: is a physical or juridical person who offers services and/or consumption goods through Rio de Janeiro PASS card.
IV - ATTRACTIONS: are the touristic attractions, entertainments, promenades, tours developed in the city of Rio de Janeiro.
2 - THROUGH THE CONTRACTUAL OBJECTIVE:
2.1 - The aim of this present contract is the use regulation of Rio de Janeiro PASS card through the USER.
3 - FROM THE ADHESION THROUGH THE CONTRACT:
3.1 - The USER adhesion to this contract is the entire approval of all its terms which is given at the payment of Rio de Janeiro Pass card.
4 - THROUGH THE REGRET RIGHT:
4.1 - the USER can, in the unpostponable delay of 7 days, starting from the effective payment date of Rio de Janeiro PASS card and only if it hasn’t been used yet, regret the realized contract and plead the contractual revocation having the right to the integral value refund until that moment. For that, the USER should contact the customer service: + 55 21 4063-7377 or by sms at + 55 11 7028-7875 or even by mail through citywaypass@citywaypass.com .
4.2 - By no hypothesis, the USER can request the refund of the value if he has already used his Rio de Janeiro PASS card.
5 - THROUGH THE PAYMENT:
5.1 - The USER will do the payment of Rio de Janeiro PASS card through credit card giving the necessary data on the appropriated and safe page of the site riodejaneiropass.com
5.2 - The value of Rio de Janeiro Pass card is the one publicized on the site riodejaneiropass.com at the contractual moment.
6 - THROUGH RIO DE JANEIRO PASS CARD DELIVERY:
6.1 - The USER can opt between receiving Rio de Janeiro PASS card at the address given, which implies a posting fee publicized on the site riodejaneiropass.com. Or can buy Rio de Janeiro PASS card personally on the shop Rio In Box located in the city of Rio de Janeiro at the Avenida Nossa Senhora de Copacabana, 1.226.
7 - THROUGH RIO DE JANEIRO PASS CARD:
7.1 - Rio de Janeiro PASS card offers the USER the possibility to enjoy for free, through the contractual period (1, 3 or 7 days), many accredited attractions in the city of Rio de Janeiro.
7.2 - Rio de Janeiro PASS card is personal and untransferable and its use will be conditioned to its presentation to the serviceable accredited person together with the presentation of the official USER ID document.
8 - THROUGH THE MODALITIES OF RIO DE JANEIRO PASS CARD:
8.1 - Rio de Janeiro Pass card can be acquired in three modalities: for 1 day duration; 3 days and 7 days.
8.2 - Rio de Janeiro PASS card acquired for 1 day duration will allow the USER to use for free the accredited attractions offered in the city of Rio de Janeiro during 1 day.
8.3 - Rio de Janeiro PASS card acquired for 3 days duration will allow the USER to use for free the accredited attractions offered in the city of Rio de Janeiro during 3 days.
8.4 - Rio de Janeiro PASS card acquired for 7 days duration will allow the USER to use for free the accredited attractions offered in the city of Rio de Janeiro during 7 days.
8.5 - For all the effects, the first day is considered as the one in which Rio de Janeiro PASS card is used for the first time and will end at midnight of this same day. For example: the USER uses for the first time Rio de Janeiro PASS card at 9 am of the day 10th of the month, so his first day will end at midnight of the tenth; if the USER starts using his card at 11 pm of the tenth, his first day will end at midnight of the tenth.
8.6 - For all the effects, in case of the modalities 3 and 7 days, such period will be consecutive and the first day will be considered as said on the item 8.5 and the second day will start just after the end of the first day, even if the USER use the Rio de Janeiro PASS card or not. For example: if the USER starts using the card the first day at 11 pm from the day 10th of the month, you first day will end at midnight of the tenth and the second day will start on the first second of the eleventh and end at midnight of the eleventh; the third day will start on the first second of the twelfth and end at midnight of the twelfth, and so on.
9 - THROUGH THE ATTRACTIONS:
9.1 - The attractions offered by Rio de Janeiro PASS card to the USER through the accredited partners will be available on a specific way and actualized on the site riodejaneiropass.com.
9.2 - The attractions offered by Rio de Janeiro PASS card to the USER through the accredited partners can be modified, excluded or included without previous notice, CITYWAYPASS guarantees the USER that it will offered at least 25 different opportunities of attractions.
9.3 - The USER knows that CITYWAYPASS through Rio de Janeiro PASS card works only as an intermediary between him and the accredited attractions. So any material or moral damages occasioned to the USER due to a default of the serviceable person relative to the attraction, should be the object of request and judicial action against the accredited serviceable person, but never against CITYWAYPASS, which only delivers the USER the necessary data of the accredited serviceable person to start the necessary measures.
9.4 - The USER could not repeat the attraction, so he could only visit once and in personal and untransferable manner each attraction offered by Rio de Janeiro PASS card through the accredited partners.
10 - THROUGH THE VALIDITY OF RIO DE JANEIRO PASS CARD:
10.1 - Rio de Janeiro PASS card will be valid during one year starting from the contractual date (buying date).
11 - LOSING, STEALING AND STRAYING of RIO DE JANEIRO PASS CARD:
11.1 - In case of stealing, losing or straying of Rio de Janeiro PASS card, the USER will receive for free and immediately another card which will be valid for the remaining time of your previous card.
11.2 - In case of stealing, losing or straying of Rio de Janeiro PASS card, the USER must contact immediately the customer service through the number + 55 21 4063-7377 or by SMS to + 55 11 7028-7875, or even access our site with you data to nullify your card.
11.3 - The USER will be responsible for the use of Rio de Janeiro PASS card until the communication to the customer service of the stealing, losing or straying of the card. 11.4 - The new Rio de Janeiro PASS card will be withdrawn personally by the USER at the shop Rio In Box located in the city of Rio de Janeiro at Avenida Nossa Senhora de Copacabana, 1.226.
11.5 - Due to the fact that the emission of the new card is immediate, the period between the communication of the fact and the emission of the new card will not be restitute by no hypothesis to the USER.
12 - THROUGH THE COMPETENT FORUM:
12.1 - The parties chose to cancel all and any doubts and contests that may occur from the present contract, disclaiming any other, for more privileged that it is, the Forum Comarca da Capital do Estado de São Paulo.
13 – THROUGH THE FINAL DISPOSITIONS:
13.1 – This contractual relation is ruled by the Brazilian legislation.
13.2 - This adhesion term is duly registered in 3º Oficial de Registro de Títulos e Documentos e Civil de Pessoa Jurídica da Capital - CNPJ: 45.572.625/0001-66 Praça Manoel de Nóbrega, 20 - Centro - CEP: 01015-010 - São Paulo/SP
